It was not an abuse of process for a defendant to have been prosecuted for failing to comply with an enforcement notice, notwithstanding that he had been out of the jurisdiction and unaware of the notice throughout the period when an appeal could have been lodged, in circumstances where he ought to have been aware that such a notice was likely to be served.
