There was nothing in the Extradition Act 2003 s.78(4) that required a judge at the extradition hearing to be satisfied that documents sent to him by the secretary of state had been served on the person whose extradition was requested prior to the commencement of the extradition hearing. It was not too late to effect service at the hearing.
