When stating that "intelligible testimony is evidence that is capable of being understood" a court had applied the correct test for the purposes of the Criminal Justice Act 1988 s.33A(2A), as set out in R. v Hampshire (David Peter) [1996] Q.B. 1, in determining the competence of child witnesses to give evidence.
