A decision of the Solicitors Disciplinary Tribunal that a solicitor found guilty of conduct unbefitting a solicitor should be debarred from practising as a sole practitioner had been reached on a flawed basis, particularly as the tribunal had failed to invite him to make submissions as to whether he should be permitted to continue as such, and it was improper for the tribunal to place reliance on a previous decision in relation to his conduct when it did not have the appeal judgment in those proceedings.
