A magistrates' court had erred in acquitting the premises licence holder/supervisor of a social club of an offence under the Copyright, Designs and Patents Act 1988 s.297(1), where he only had a residential Virgin Media package including Sky Sports Live for his flat situated above the licensed area and had broadcast premiership football games to which BSkyB had exclusive rights in the licensed area. The magistrates' court's interpretation of s.297 had been too narrow as there was a difference between domestic and commercial use.
