An employee had not been discriminated against on the grounds of disability where he had been suffering from a legitimate medical impairment that was the underlying cause of an excluded condition under the Disability Discrimination (Meaning of Disability) Regulations 1996 reg.4, and the sole reason for the less favourable treatment related to the excluded condition rather than the legitimate medical impairment.
