A prosecutor seeking to show that he had had reasonable and probable cause to charge a suspect did not have to consider, at the time of charging, the possibility that evidence might be excluded at the trial after full legal argument or in the exercise of the judge's discretion; nor was it necessary to test the full strength of the suspect's defence.
