The magistrates' court had erred in law in staying informations brought against individuals in respect of offences under the Social Security Administration Act 1992 s.111A for being an abuse of process as the power to stay proceedings was to be used only in exceptional cases and there was nothing to suggest that it was not possible for the individuals to receive a fair trial.
