Where the prosecution had allowed three months to pass before challenging an apparently inappropriate listing decision, it was not entitled to an extension of custody time limits when it turned out that the earliest available listing was after the expiry of those time limits. That was because it had not acted with due diligence and expedition within the meaning of the Prosecution of Offences Act 1985 s.22(3)(b).
