[2006] EWCA Crim 1742

An indication to the immediate purchaser that a product was a replica did not of itself exclude a conclusion that the signs in question were indicative of trade origin so as to give rise to the commission of an offence under the Trade Marks Act 1994 s.92(1)(b) and s.92(1)(c).
