Where a respondent had been acquitted of criminal charges and a local authority used the evidence from those failed proceedings to obtain an anti-social behaviour order against the respondent, it was not open to a chief constable to argue that civil proceedings brought by the respondent for damages stemming from the failed criminal proceedings were an abuse of process.
