In extradition proceedings in relation to whether an individual convicted in his absence would receive a retrial that accorded with the European Convention on Human Rights 1950 Protocol 1 Art.6 if extradited, it was unnecessary to examine what a requesting state did in practice provided that the Convention was unequivocally incorporated into its body of laws and that the terms of the Convention would prevail if any conflict arose between it and those laws.
