[2006] UKPC 46

If a criminal case was not heard and completed within a reasonable time, that would of itself constitute a breach of the right under the Constitution of Mauritius s.10(1) to a fair trial within a reasonable time, regardless of whether the defendant had been prejudiced by the delay.
