The Road Traffic Offenders Act 1988 s.1(3) deemed that a notice of an intended prosecution under s.1(1) had been given unless the contrary was proved. The prosecution did not have to prove service of the warning where the defendant, facing a charge of failing to identify the driver of a car contrary to the Road Traffic Act 1988 s.172(3), gave no evidence to the contrary.
