A sentence of three and a half years was appropriate at first instance for cases of attempted GBH with intent in domestic violence situations, a sentence of two years was unduly lenient. However, as the defendant had already been released from prison, and, if ordered to return it would only be for a short period, the correct approach was to make a declaration as to the correct sentence for future guidance only.
