[2010] EWCA Crim 238

The only circumstances to which the decision in R. v Afonso (Americo Practicio) [2004] EWCA Crim 2342, [2005] 1 Cr. App. R. (S.) 99 applied were those in which the defendant was himself an addict, was out of work and had no honest possibility of income, held no stock, and where the only supply that he had made was in the course of a test purchase by a police officer, so that his actions had not increased the circulation of dangerous drugs.
