The provisions of the Criminal Procedure Ordinance 1952 (Gibraltar) s.232 did not violate the provisions of the Constitution of Gibraltar. Accordingly a privately-funded defendant acquitted on indictment was effectively unable to recover his costs of defence from the prosecutor, save in rare cases.
