Where there was a clear case for ordering a split trial with a jury determining the question of liability and the judge determining damages in a case where a claimant had sought damages for false imprisonment and assault, there was no difficulty in the judge asking the jury whether the aggravated and exemplary damages which had been sought should be awarded, leaving it to the judge to determine issues of quantum at the damages hearing.
