It was appropriate to quash a refusal to grant bail pending retrial because the judge had inappropriately taken into account a factor that was not open to her on the evidence, namely the likely effectiveness or otherwise of proposed bail conditions, and had failed to take into account a relevant factor, namely the correct date for determining how long the individual would have spent on remand by the end of the retrial.
