[2004] EWCA Crim 163

A conditional discharge for an offence of indecent assault was lenient but not unduly lenient, a community rehabilitation order would have been the appropriate sentence to reflect an element of punishment. However, as the defendant had been punished by the threat of the reference hanging over him, the court would not interfere with the sentence.
