Where an offender had been recalled to prison under the Criminal Justice Act 1991 s.39, and was subsequently ordered under the Powers of Criminal Courts (Sentencing) Act 2000 s.116 to serve the unexpired period of his previous sentence, the maximum period under s.116 should be replaced with a part-period to give credit for the administrative recall under s.39.
