The court declined to give a prisoner leave to appeal against his sentence on compassionate grounds where he had suffered a stroke and wished to seek medical treatment in the community. His sentence was not unlawful, wrong in principle or manifestly excessive and it was a matter for the secretary of state to decide whether to exercise his discretion to release him on licence under the Criminal Justice Act 2003 s.248(1).
