Although breach of the Crime and Disorder Act 1998 s.1(10) was a strict liability offence, where a defendant raised an issue as to his state of mind in relation to the breach and satisfied the evidential burden upon him in that respect, his state of mind had to be taken into account in determining whether the Crown had proved there was no reasonable excuse, and the burden of so proving rested upon the Crown.
