Weird cases: indecent exposure or too trifling?

The legal principle de minimis non curat lex means that the law does not concern itself with things which are too trifling ? a single rotten apple, for example, in a consignment of a thousand apples. The principle is now being advanced for the first time as a defence to an indecent exposure charge by a man who says his genitals are too small to cause offence.
