[2004] EWHC 2691 (QB)

A defendant found to have committed the actus reus of an offence, who had as a result been subject to an order under the Mental Health Act 1983 s.37 but who no longer exhibited the symptoms of a mental disorder, could remain subject to the options available under that order where he still suffered from the underlying mental disorder.
