[2012] EWHC 472 (Admin)

A European arrest warrant containing a count alleging the unlawful use of drugs contained insufficient particulars for a "necessary inference" that the extraditee had been in unlawful possession of controlled drugs. Therefore, it was not established that the conduct alleged would have amounted to an offence in the United Kingdom in order to satisfy the requirements for an extradition offence under the Extradition Act 2003 s.64(3).
