It would be unjust and oppressive to return an Italian national to the Netherlands to serve an eight-month sentence of imprisonment for a relatively minor offence of drug possession after a 16-year delay where neither the appellant nor the Dutch authorities were at fault for the delay, the appellant had been entitled to believe that his deportation from the Netherlands had replaced any further penalty, and he was making attempts to change his lifestyle.
