A third party mobile telephone service provider was entitled to its costs of attending a hearing in which it successfully sought the discharge of a witness summons that had been applied for by a defendant in the context of criminal proceedings. However, a wasted costs order was made against the defendant's firm of solicitors that had acted unreasonably in persisting with the pointless application for the summons.
