In deciding whether a certificate of inadequacy should be granted, the court could not go behind the finding as to hidden assets made by the Crown Court at the confiscation hearing, but that did not lead the court to the assumption that those assets had to exist; or rather, the assumption that those assets existed was one which at the instant stage could be the subject of material in order to show that the defendant had made no profit from those assets.
