Where a fugitive had been convicted and sentenced in his absence in a state requesting his extradition, but the conviction and sentence were neither final nor enforceable, his case could be treated as an accusation case within the Extradition Act 2003 s.2(3) even though he did not enjoy an unqualified right to a re-trial on the merits.
