[2010] EWCA Crim 1294

Despite an earlier decision to release from prison on compassionate grounds a 78-year-old offender suffering from ill health, the judge in subsequent confiscation proceedings had not erred in imposing on the offender a confiscation order with a period of three years' imprisonment in default of payment. It had been concluded at the confiscation hearing that the offender was able to make the relevant payment and therefore any return to prison would be his own choice.
