Following the decision in R. v Terrell (Alexander James) [2007] EWCA Crim 3079, [2008] 2 All E.R. 1065, a sentence of imprisonment for public protection was no longer appropriate for an offender who had pleaded guilty to offences of the distribution of an indecent photograph of a child, as those offences did not indicate the risk of serious harm contemplated by the Criminal Justice Act 2003.
