The right to an interlocutory appeal in Crown Court trials was an exceptional one and the court's power to grant permission for such an appeal under the Criminal Justice Act 1987 s.9(11) was restricted by s.9(3)(c) of that Act to issues which raised questions of law going to the root of the case.
