Where a juror made prejudicial comments about a defendant during a trial, in the mistaken belief that the information on which his comments was based referred to the defendant whereas in fact the comments related to a co-defendant who was subsequently acquitted, the effect on the defendant's trial would be unfair and his conviction unsafe.
