In an appeal against a sentence of 12 months' imprisonment for an offence of causing death by dangerous driving, whilst there were exceptional circumstances in the case which justified a suspended sentence for the lesser offence of dangerous driving, such circumstances were not transferable so as to justify suspending a sentence for the instant offence and accordingly the appeal had to fail.
