Although some criticism could be made of the judge's summing up because his direction on the consequences of the failure to hold an identification parade were not as clear as they might have been following R v Forbes (2001) 1 CAR 430, all the points that should have been made to the jury were in fact made and there was no misdirection. Therefore it could not be said that the appellant's conviction was unsafe.
