[2002] EWHC 2497 (Admin)

The policy guidance issued by the Secretary of State for the Home Department was wrong in law insofar as it stated that the Children Act 1989 did not apply to persons under 18 years of age in prison establishments. The Act did apply, subject to the necessary requirements of imprisonment.
