Convictions for conspiracy to steal cars and conspiracy to handle the stolen cars were unsafe as the judge had failed to remind the jury of the defendant's defence in his summing up. The case had been circumstantial and was not an exceptional case where the convictions could be held to be safe despite the judge's omission.
