[2010] EWCA Crim 1462

A judge had erred by imposing a discretionary life sentence upon a 13-year-old who had committed a serious sexual offence when it had been open to him to address the risk posed to public safety by ordering detention under the Powers of Criminal Courts (Sentencing) Act 2000 s.91 with a longer than commensurate term, coupled with an extended licence period.
