In determining the appropriate fine for an offence under the Planning (Listed Buildings and Conservation Areas) Act 1990 s.9, the court was required to "have regard" to any financial benefit accruing to the defendant in consequence of the offence. However, there was no obligation to order a fine in the full amount of that benefit, or even a large proportion of it.
