When making a confiscation order against the appellant, who had pleaded guilty to corruption after providing gifts to a Network Rail employee with a view to securing work for his company, the judge had been correct to rule that the corporate veil should be lifted when assessing the benefit obtained by the appellant; however, the figure of £1.9 million in which the confiscation order was made, representing the total sum paid to the appellant's company by Network Rail, was disproportionate.
