[2010] EWCA Crim 107

A fine of £3,500, to be paid at the rate of £500 per month with a period of six months' imprisonment in default of payment, imposed for an offence of careless driving where death had resulted, was reduced to £1,000 to be paid at the rate of £200 per month. It was appropriate to use the magistrates' court sentencing guidelines for the offence of careless driving and then to add a very significant uplift for the consequential death, whilst attempting to bring fairness and proportionality to the sentence according to the comparative means of offenders.
