A defendant's assertion that he had a well founded fear of persecution did not amount to a reasonable excuse within the meaning of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 s.35(3) since the provision had been created to deal with the practicalities of compliance with deportation rather than a defendant's willingness to comply.
