[2010] EWCA Crim 3284

The power to resentence under the Criminal Justice Act 2003 Sch.8 Pt 5 para.23 should not be construed as requiring the judge to turn the clock back to the day on which the community order was made and resentence as if nothing had happened in the meantime.
