Although a judge had imposed a term of 26 weeks' imprisonment for an offence of harassment, without appreciating that he had no power to pass a sentence which would take effect after the expiry of the recall period from a previous sentence, it was not appropriate in the circumstances to exercise the Powers of Criminal Courts (Sentencing) Act 2000 s.155 in order to increase the term.
