A sentence of 27 months' detention, and a concurrent sentence of four months' detention, imposed following late guilty pleas to offences of burglary and taking a conveyance without authority, was not manifestly excessive where the offender had a lengthy criminal record and the offence involved a night-time burglary of a house when the occupier was at home, causing great and lasting distress to the victim. Although the trial judge had accepted that it was a Category 2 offence, where there were especially serious consequences a judge could take that into account to push a case above the guidelines.
