[2013] EWCA Crim 1261

Where a count was added to an indictment in breach of the Criminal Justice Act 1988 s.40(1) and the Criminal Procedure Rules 2012 Pt 14, any conviction recorded in relation to the improperly joined count was nullified but the indictment as a whole was not invalidated.
