[2010] EWCA Crim 829
An offender's beneficial interest in a jointly-owned property was taken into account when making a confiscation order under the Proceeds of Crime Act 2002, although that beneficial interest could not be realised without selling the whole property. The possibility that the offender would not obtain an order for sale of the whole property did not affect or diminish its market value when assessing the value of that beneficial interest.
