The magistrates had not been entitled to exercise their power under s.73 Crime and Disorder Act 1998 and to sentence the applicant to custody because they had accepted jurisdiction prior to the section coming into force thereby creating a legitimate expectation that the applicant would not receive a custodial sentence.
