Where an offender fell to be sentenced under the "three-strikes" provisions in the Powers of Criminal Courts (Sentencing) Act 2000 s.111, the correct approach was for the judge to have regard to the guidelines issued by the Sentencing Council and to ensure that the term of imprisonment imposed was not less than three years. The statutory minimum term and the starting point indicated by the Sentencing Council were not intended to be cumulative.
